Intellectual Property, Brand Guidelines & DMCA Policy

Comprehensive legal shield for AthyriumStudio / AthyriumStudios against cybersquatting, passing off, and statutory DMCA protocol.

Executive Legal Statement

The brand names AthyriumStudio and AthyriumStudios, their 3D monogram, and corporate trade dress are internationally shielded against commercial confusion and unauthorized usurpation. Third-party use within the software or digital domain constitutes trademark infringement and passing off, enforceable through UDRP domain dispute proceedings (WIPO/ICANN), statutory Cease & Desist actions, and injunctive relief. Concurrently, we maintain a designated 17 U.S.C. § 512 (DMCA) agent for copyright inquiries while safeguarding our clients with an irrevocable 100% intellectual property transfer for all delivered software.

1. Trademark Ownership, Commercial Trade Names & Distinctive Signs

a) Protected Distinctive Signs: The commercial designations "AthyriumStudio", "AthyriumStudios", the geometric 3D monogram "A", the official typographic wordmark, corporate color palette tokens (trade dress), brand guidelines, and associated taglines are exclusive trademarks and distinctive signs of AthyriumStudio ("the Agency"). b) Scope of Protection: Protection covers custom software engineering, cloud architecture, applied artificial intelligence solutions, tech advisory, web and mobile platforms, static code audits, and related computer systems engineering in international and domestic markets. c) Legal Basis: Protection is anchored under WIPO (World Intellectual Property Organization) treaties, the Paris Convention for the Protection of Industrial Property, the Andean Community Decision 486 (Common Industrial Property Regime), the Lanham Act (15 U.S.C. § 1051 et seq.), and international anti-unfair competition and consumer confusion statutes.

2. Prohibition of Impersonation, Cybersquatting & Market Confusion

The following unlawful practices are strictly prohibited for any individual, corporation, competitor, or third-party entity: 1. Cybersquatting and Typosquatting: Registering, acquiring, trafficking in, using, or selling top-level domain names (gTLDs such as .com, .net, .org, .io, .ai, .studio, .agency) or country-code domains (ccTLDs such as .co, .es, .us, .com.co) containing in whole, in part, phonetically, or via deliberate misspelling the names "AthyriumStudio", "AthyriumStudios", or confusingly similar variants. • AthyriumStudio will vigorously enforce its rights via the Uniform Domain Name Dispute Resolution Policy (UDRP) through WIPO / ICANN or through the Anticybersquatting Consumer Protection Act (ACPA, 15 U.S.C. § 1125(d)), seeking mandatory domain transfer and statutory damages. 2. Digital Impersonation & Passing Off: Creating unauthorized profiles, channels, package repositories, or organizations on digital platforms (including GitHub, GitLab, npm, PyPI, Docker Hub, LinkedIn, X/Twitter, Instagram, Discord, Telegram, WhatsApp, or Slack) simulating or claiming affiliation, agency representation, or authority to contract on behalf of AthyriumStudio. 3. Deceptive Traffic Redirection & Unfair Competition: Bidding on or utilizing our brand terms as keyword triggers in deceptive ad campaigns (Google Ads, Meta Ads) or SEO keyword-stuffing designed to siphon consumer traffic by misleading prospective clients into believing they are transacting with AthyriumStudio.

3. Permitted Usage Guidelines & Strict Trademark Restrictions

a) Permitted Nominative Fair Use: You may reference the name "AthyriumStudio" strictly for legitimate nominative editorial, educational, or journalistic commentary, provided that: • No affiliation, endorsement, sponsorship, or partnership is stated or implied where none exists. • The mention does not disparage, dilute, or damage the commercial and technical reputation of the Agency. • The reference is rendered in standard plain text and does not overshadow the primary brand of the publishing entity. b) Explicit Restrictions: Under no circumstances are you permitted to: 1.
